Businesses that do not have food safety officers may face fines

The Provisions on the Supervision and Administration of Enterprises' Implementation of Food Safety Subject Responsibilities (hereinafter referred to as the Provisions) will be officially implemented on November 11. The Provisions require that food production and trading enterprises with a certain scale should appoint food safety directors in accordance with the law while appointing food safety officers. If a food production and trading enterprise fails to equip, train or assess food safety management personnel in accordance with regulations, the local market regulatory department at or above the county level shall order corrections and give warnings; where corrections are refused, a fine of between 1,5000 and 5,<> yuan shall be imposed; If the circumstances are serious, it shall be ordered to suspend production and business until the license is revoked.

In principle, recalled drugs cannot be remarketed

The State Food and Drug Administration issued a new revision of the Administrative Measures for Drug Recalls, which came into force on November 11. Regarding the whereabouts of recalled drugs that the public is worried about, the Measures point out that, in principle, recalled drugs cannot be relisted. However, for those that can eliminate hidden dangers by changing labels, modifying and improving instructions, repackaging and other means, or Chinese medicine pieces that do not meet drug standards but do not affect safety and effectiveness, and can be solved through rework, etc., they can be treated in an appropriate way before being marketed.

Fully implement the electronic registration certificate of medical devices

The website of the State Food and Drug Administration released the "Announcement on the Full Implementation of the Electronic Registration Certificate for Medical Devices", and from November 11, the electronic registration certificate of medical devices will be fully implemented. The announcement shows that the electronic registration certificate of medical devices has the same legal effect as the paper registration certificate. The scope of issuance of the electronic registration certificate for medical devices is the registration certificate and registration change documents for domestic Class III, imported Class II and Class III medical devices approved by the State Food and Drug Administration from November 1, 2022.
